Victory in "Same-Sex Divorce" Case


A The Dallas Court of Appeals reversed District Judge Tena Callahan's ruling that granted a "same-sex divorce" to two men who were "married" in Massachusetts.


By granting a "same-sex" divorce, this activist judge tried to recognize a marriage that never existed in Texas and actually violates the Texas Constitution. In 2005, the voters of Texas passed a constitutional amendment defining marriage as the union of one man and one woman by a margin of 76 percent!


Liberty Institute argued alongside the Texas Attorney General's office that this marriage is void since Texas doesn't recognize the union, which ends the relationship without overturning the Constitution.


The Dallas Court of Appeals agreed and struck down Judge Callahan's ruling and required her to dismiss the case within seven days.


This is an important victory since the same arguments made in this case were also made in California's Proposition 8 case, yet the court rejected these arguments as invalid.


These very issues will be the ones ultimately decided by the U.S. Supreme Court.
